Type of a scam Home Improvement

We were referred from the Georgetown Mommies group for a contractor for fences and decks. I emailed Dave Ingham of Top-Notch Home Maintenance Ltd. He came out to take measurements to build us a deck and shelter over and to replace our gate to our backyard. He asked for 50% deposit to reserve the job. We did two e-transfers one for $2000 and the next for $2500. He was to start on September 18th. I contacted him the night before to confirm and he said all was good. The next day came and he did not show up. I emailed and texted him and no response. Finally two days later he responds that something came up. I said you must then return our $4500 that we sent him by that Friday and we will have to find someone else. We told him we would take legal action if he did not return our money. He has since not responded and it has been a month. He says he has been serving Halton hills, Burlington, Oakville and Brampton. Wanted to make everyone aware as this is theft/fraud and a scam for Top-Notch Home Maintenance Ltd. His business was legit, as I contacted Canada Revenue Agency and he had an HST number. He still stole our money and did not perform the service. He should be charged for fraud. I have contacted and filed a Halton Fraud Report as well and reported here to ScamPulse.com and Consumer Protection Ontario as well as Canadian Anti-Fraud Centre. I just want to warn others that even a real legit company can do this to a customer. He needs to be stopped, arrested and his business to be closed. We just want our $4500 back that we are paying interest on from our line of credit borrowed. Thank you for your help.
