My friend and I have been searching for apartments for quite some time, and found this one that we were interested in. The landlord, John Hennessy, asked that we pay $150 to apply since they "hold the apartment off market" until the application is processed. The $150 is a combination of processing fee and holding charge, in which would go towards our deposit if we signed the lease upon approval. We agreed and he told us that if we do not accept the lease after approval, we have a 5 day grace period to withdraw and receive our money back minus processing fee.

We heard back from John on January 14th and were notified of our approval. Only 2 days before I had accepted a job offer in California so we declined signing the lease. We reached out to John to notify him of this on the 16th, 2 days into the 5 day allowed grace period.

John then became offended, rude, and stated that due to the wording of the agreement, he didn’t ACTUALLY mean we get it back. So, now, as a broke college student with moving expenses and other living expenses to worry about, John decides he’s going to take and withhold $150 out of spite that we decided not to sign the lease with him.

I will attach the lease agreement, which very clearly states that we are to be receiving our money back that he is wrongfully with holding. He has now stopped answering our calls and texts.
